Colorado seeks input on updates to communicable disease reporting rules

The Colorado Department of Public Health and Environment (CDPHE) is seeking public input on proposed updates to the communicable disease regulations under 6 CCR 1009-1. These rules list the diseases that must be reported to CDPHE and local public health agencies to help protect public health.

The regulations outline the authority of public health officials to investigate epidemic and communicable diseases and implement control measures. They also specify which conditions and outbreaks must be reported, who is responsible for reporting, deadlines for submitting reports, how reports should be made, and detail provisions regarding access to medical records when necessary for investigations.

Public feedback on any aspect of 6 CCR 1009-1 can be provided in two ways. First, interested individuals may attend a virtual listening session scheduled for noon to 1 p.m. on September 16, 2025. During this session, CDPHE staff will review the proposed changes and take comments from attendees. Registration is required in advance through the same webpage: https://cdphe.colorado.gov/about-cdphe/boards-and-commissions/public-health-rules-and-regulations/communicable-disease-rulemaking.

Alternatively, feedback can be submitted using CDPHE’s online form available at the same link above. Comments must be received by 5 p.m. on Thursday, September 25. All feedback should pertain specifically to 6 CCR 1009-1.

Feedback collected at this stage will inform CDPHE staff as they draft updates for possible submission to the Board of Health. The agency notes that these initial comments will not go directly to the Board or become part of the official record but may shape what is ultimately presented for formal rulemaking consideration. If rulemaking proceeds, there will later be an opportunity for additional public comment directly to the Board of Health as part of the official record.

“Feedback submitted at this time is for consideration by CDPHE in drafting the proposed rule updates. CDPHE program staff will consider it and potentially incorporate it into the request for rulemaking packet submitted to the Board of Health. Feedback submitted at this time will not be directly transmitted to the Board of Health or become a part of the official rule record. Once the Board of Health grants the request for rulemaking, the public will have the opportunity to submit comments directly to the Board of Health, which will be included in their entirety with the formal record,” according to information provided by CDPHE.
